Finance & Creditors’ Rights
Our Finance & Creditors’ Rights Practice Group assists clients in connection with the life-blood of their businesses and of the overall economy: the extension and enforcement of credit. We are involved in all stages of the life of a financial transaction, and represent banks and other lenders in the negotiation, documentation, and collateralization of every type of loan transaction, including:
- Commercial and industrial (C&I) lending
- Real estate and construction lending
- Equipment leasing and financing
- Asset based loans
- Agricultural loans
- SBA, FSA, USDA, and other government-guaranteed loans
- New market tax credit
- Interest rate swaps
- Mezzanine financing
- Syndicated loans
- Loan participations
- Floor plan financing
- Municipal and other bond transactions
- Residential mortgage lending
When specific loan assets become non-performing or otherwise troubled, we can assist with:
- Loan documentation and collateral review
- Title, environmental, and other due diligence
- Loan modification and restructuring
- Workout and orderly liquidations including secured party sales
- Judicial enforcement including confession of judgment, mortgage foreclosures, personal property executions, and actions on notes and guarantees
- Sale of loans individually or in pools
- Lender liability issues
- Enforcement of lenders’ rights in bankruptcy including cash collateral orders, plan objections, and relief from the automatic stay
- Managing and disposing of REO real estate
- Compliance with all regulatory and other legal protections for consumer and other borrowers
In addition to the work we do for lenders, the attorneys in our group represent all of our clients, including businesses, institutions, and individuals, in connection with all aspects of credit transactions including:
- Development and implementation of credit policies
- Credit applications and agreements
- Receivables monitoring and enforcement
- Collections
- Judgment enforcement
- Lease terminations and evictions
- Representation of creditors in bankruptcy including enforcement of administrative claims and defense against preferences
We work on transactions throughout Pennsylvania and Maryland and also get involved in multi-state transactions where Pennsylvania or Maryland creditors, borrowers or collateral are involved. No transaction is too simple or too complex for us to handle. Our attorneys have appeared in all state and federal courts in Pennsylvania as well as courts in several other states. We work to maximize the chances that clients will be paid for their products and services, and will be re-paid for money that is loaned.
