Luke T. Weber

Luke is a trial attorney in the firm’s Litigation and Health Care groups. He serves as chair of the Health Care Industry Group. In his career, Luke has represented clients in numerous cases throughout Pennsylvania in both state and federal courts. He prides himself on applying methodical case preparation and strategic litigation planning to obtain favorable outcomes for his clients. Luke is experienced in all stages of litigation from addressing disputes prior to the filing of a lawsuit through presenting the case to a jury at trial and on appeal. He is also adept at resolving matters through alternative dispute resolution, including confidential mediations and arbitrations when advantageous to the client goals in any particular case.

Luke devotes a substantial portion of this practice to defending doctors, hospitals and other health care professionals against medical malpractice claims. While collaborating with some of the most highly respected medical experts in the country, Luke has experience defending malpractice claims in a wide variety of specialties: obstetrics and gynecology, neurosurgery, pediatrics, cardiovascular and thoracic surgery, general surgery, neurology, radiology, oncology, dermatology, urology, anesthesiology, neonatology, infectious disease, emergency medicine, hospital medicine, pathology, nursing care, and primary care medicine.

In addition to defending medical malpractice cases, Luke has defended product liability cases, class actions, regulatory prosecutions and various personal injury matters in the health care sector.  He also supports hospital clients in conducting peer review investigations and medical board adjudications.

Luke maintains an active commercial litigation practice in addition to his medical malpractice docket. He frequently represents clients in commercial cases involving contract and business disputes, including those against governmental entities, and provides guidance to clients regarding potential claims or liabilities. In addition to pursuing and defending actions in Pennsylvania and New Jersey, Luke has been granted special admissions to practice in other states where necessary to litigate cases on behalf of clients. In handling complex litigation, Luke has experience conducting multi-state and transnational discovery as well as coordinating electronic discovery.

Luke was recently recognized for his experience by the Pennsylvania Supreme Court and received an appointment to its Committee on the Rules of Evidence.  The committee provides recommendations to the court regarding evidence matters by monitoring the application of rules and developments in case law as well as identifying areas in which rules of evidence should be revised or clarified. The committee typically consists of a small number of judges and attorneys throughout the state.

Luke also regularly engages in pro bono work.  For example, as part of a project with the Pennsylvania Immigration Resource Center and the Lancaster Bar Association, Luke filed a pro bono suit against the U.S. Department of Homeland Security and its related agencies seeking protected immigration status and employment authorization for a victim of domestic violence. Ultimately, to resolve the matter, the U.S. Citizenship and Immigration Services awarded Luke’s client deferred action status, issued her an employment authorization and placed her on a pathway to citizenship.

Before going into private practice, Luke trained under a series of judges, including in the Pennsylvania Supreme Court, the Pennsylvania Commonwealth Court, and the U.S. District Court for the Middle District of Pennsylvania. By working for both state and federal judges, Luke gained first-hand experience in a wide array of matters including employment and labor disputes, municipal claims, state regulatory prosecutions, land use litigation and constitutional law challenges at both the trial and appellate levels.

At Penn State University Dickinson School of Law, he was a member of the schools national trial competition team and an associate editor of the Penn State Law Review. Luke also participated in a medical-legal colloquium in conjunction with the Milton S. Hershey School of Medicine.

A Lancaster County native, Luke lives just outside Lancaster with his wife, Ashley, and their two young daughters.

Robert M. Frankhouser

Bob Frankhouser is a member of the firm’s Education, Employment and Labor Law practice groups. He provides advice and representation to educational entities both as a general solicitor and as special counsel. In addition, Bob counsels employers on employment issues with special emphasis on labor union matters.

Bob’s legal career has been fueled by a dedication to creating innovative solutions for the unique challenges his clients encounter. During his nearly 50 years in practice, he has represented school districts in many employment and construction matters. In addition, Bob serves as the solicitor of record for a variety of educational entities, providing guidance on governance, general business issues and labor relations matters.

He also has years of experience in labor/management relations, negotiating for and providing counsel to the firm’s public school district clients on collective bargaining agreements. Furthermore, he has litigated a wide variety of labor disputes for both the public and private employers he has represented.

Lori McElroy

Government tax regulations are constantly changing, and Lori McElroy’s experience as a member of Barley Snyder’s Tax Practice Group has given her an intimate understanding of the financial restrictions that can slow a business down, and how to rectify them. She works to solve complex governmental regulations and restrictions for qualified retirement plans from both an implementation and operation standpoint, and has experience with corporate and individual tax issues surrounding business formations and reorganizations. Lori also has experience in working with the Internal Revenue Service in defense of qualified plans as well as for individual clients and entities in tax controversies.

Lori has helped the firm carve out the niche of working with companies in converting to the very popular but also very complex employee stock ownership plans (ESOP). She also works in the areas of employees benefits when it comes to nonqualified deferred compensation, the Employee Retirement Income Security Act of 1974 (ERISA), executive compensation, qualified plan audits from the U.S. Department of Labor as well as charitable giving.

Lori is also fundamentally involved in various aspects of estate planning and wealth management, as well as the implementation and operation of a variety of charitable trusts, as well as helping individuals in other areas of charitable giving. She also regularly advises public charities and private foundations on corporate and tax matters.

Jennifer Craighead Carey

Jennifer is the firm’s managing partner and a member of the Employment Practice Group where she concentrates her practice in the areas of labor and employment law as well as school law.

In the area of employment law, Jennifer serves as both a counselor and a litigator. In her litigation role, Jennifer has handled cases at both the administrative level and in state and federal court. Jennifer regularly practices before the Pennsylvania Human Relations Commission (PHRC) and the Equal Employment Opportunity Commission (EEOC) as well as administrative agencies throughout the country, handling all manner of discrimination and retaliation claims. Jennifer routinely handles litigation in the Federal District Courts in both the Eastern and Middle Districts of Pennsylvania. Jennifer has obtained summary judgment and successful verdicts on behalf of her employer clients in numerous cases involving discrimination, harassment, and retaliation. In addition to defending discrimination cases involving sex, race, color, religion, age, disability, sexual orientation, national origin, ancestry, Veteran’s or military leave status, and other legally protected classes, Jennifer has also handled litigation for employers both at the administrative level and in state and federal courts involving claims under the Fair Labor Standards Act (FLSA), the Occupational Safety and Health Act (OSHA), the Family and Medical Leave Act (FMLA), Executive Order 11246, the False Claims Act, the Uniform Services Employment and Reemployment Rights Act (USERRA), and comparable state and local ordinances.

In her role as employment counselor, Jennifer regularly provides advice to employers on a myriad of employment issues, including counseling on performance and conduct related issues, reasonable accommodation obligations under the Americans with Disabilities Act (ADA), FMLA compliance and management, sexual and other harassment, workplace violence, and many other issues. Jennifer has worked with clients in investigations involving harassment, misappropriation of funds and other areas of misconduct, including conducting investigations of executive and high level management employees. Jennifer also has expertise in Executive Order 11246 to include affirmative action compliance for government contractors and handling OFCCP audits. Jennifer works with government contractors on hiring and compensation audits and drafting and reviewing affirmative action plans. Jennifer also has experience in assisting employers with claims involving unemployment compensation and workers’ compensation and frequently counsels clients on the interplay between the ADA, FMLA, and workers’ compensation. In addition, Jennifer reviews personnel policies for employers and has reviewed hundreds of employee handbooks for legal compliance.

Jennifer believes in a strategy of prevention for her employer clients, and in this role not only provides counseling and investigation services to employers, but also conducts a variety of on-site, workplace training in the areas of sexual and other harassment prevention, diversity, documentation strategies in the context of discipline and discharge as well as performance evaluations, FMLA/ADA/workers’ compensation interplay and management, workplace violence, union avoidance strategies for managers and supervisors, and the nuts and bolts of workplace management to prevent litigation. Jennifer is accustomed to conducting training at all levels to include employees, supervisors and managers, and executives and directors.

In her role as labor attorney, Jennifer has handled numerous labor arbitrations both in the public and private sector. In addition, she has handled labor negotiations for unionized employers, including Act 111 negotiations in in the public employer arena. Jennifer also counsels public employers on issues unique to the Heart and Lung Act and has successfully handled numerous civil service and grievance arbitrations involving termination of Heart and Lung Act benefits. Jennifer has also represented employers before the Pennsylvania Labor Relations Board and the National Labor Relations Board.

Jennifer also provides representation to universities and colleges on labor and employment matters, affirmative action compliance, student discipline, sexual assault and other sensitive issues, and on compliance with the Family Educational Rights and Privacy Act (FERPA). Jennifer regularly presents on FERPA issues, including the interplay between FERPA and HIPAA. In addition, Jennifer counsels schools on issues related to Title IX compliance and student accommodation requests under the ADA. She is also a past presenter for the Pennsylvania Association of School Business Officials (PASBO) on FMLA and ADA matters unique to school districts.

Jennifer represents clients of all sizes and in all industries and is well versed in issues unique to manufacturing and the service sector and provides employment law expertise and litigation management services to a national retailer. In addition, she regularly represents hospitals, long term care facilities, and other health care institutions in employment issues unique to those settings, including issues related to the Older Adult Protective Services Act, credentialing and staff privileges, and medication diversion, among other issues. Jennifer is also labor and employment counsel to municipalities throughout Pennsylvania.

Lindsey M. Cook

Lindsey has returned to her roots in Lancaster County in Barley Snyder’s Litigation Practice Group. She has represented some of the largest businesses in Maryland and Pennsylvania, both at a trial court level and before appellate courts. Her success stems from a dedication to develop innovative courtroom strategies to secure the best results, taking an aggressive, yet practical, approach to each case. That has helped her achieve creative solutions while providing the highest level of advocacy.

In 2021, the American Arbitration Association recognized Lindsey’s extensive commercial litigation experience and admitted her to its panel as an arbitrator. The prestigious association includes accomplished attorneys and former federal and state judges from around the country. In her arbitration practice, Lindsey strives to resolve complex disputes efficiently, while ensuring both parties are given full and fair opportunity to present their claims.

While in law school, she interned for Judge Robert M. Bell, the chief judge of the Maryland Court of Appeals. Lindsey also participated as a member of the University of Maryland’s National Trial Team and was admitted to the Order of Barristers, a recognition reserved for the top 5 percent of law students in trial advocacy.

She is a native of Lancaster County – a Warwick High School graduate – with a devotion to its residents and businesses.

Salvatore Anastasi

Sal Anastasi is a patent attorney and chairs the firm’s Intellectual Property Practice Group. He counsels clients on all aspects of intellectual property, including domestic and international patent preparation and prosecution and intellectual property litigation. He prepares and prosecutes U.S. and international patent applications in the electrical and electromechanical arts including communication systems, control systems, optics, software, business methods and Internet-related technologies, and also prepares and prosecutes trademark applications. Sal litigates intellectual property matters and prepares licensing agreements, patentability, trademark, validity and infringement opinions.

Examples of Sal’s work in the intellectual property arena include:

– Prepared legal opinions of patent invalidity to clear new electrical products for sale for a $30 million project for a client.

– Won a preliminary injunction to stop a patent infringer from making marine pilings protecting $10 million + pier contracts and bids for our client

– Worked with engineering teams in the electronics and manufacturing industries to design around patents and patent portfolios, avoiding charges of patent infringement.

– Assisted client in defending and settling a suit for copyright infringement involving mission critical software.

– Assisted artists in enforcing copyright rights in their art work.

– Negotiated settlements between parties and in formal ADR for patent infringement suits, trademark infringement actions and copyright infringement assertions.

– Counseled clients in the manufacturing and electronics industries in building IP portfolios, enforcing them and using them as levers in negotiation to drive settlements in subsequent litigation.

Sal works with clients ranging in size from small family businesses to large, multi-national companies, in a wide variety of industries, including the automotive, electronics, communications, medical device, fiber optics, software, agriculture, machinery, manufacturing and tool industries, among others.

Prior to joining Barley Snyder, Sal was a patent attorney with The Whitaker Corporation/AMP and Tyco Electronics. In addition to his legal experience, Sal’s professional experience includes work as a practicing engineer in the electrical and electromechanical fields.

Sarah Rubright McCahon

When most people think of estate planning, they immediately think about a will. But Sarah, a member of the firm’s Trusts & Estates Practice Group, understands the complexity of a complete estate plan to ensure that a person’s wishes are carried out, which goes much further than a will.

While she has helped many clients draft their wills, she is also qualified at developing comprehensive estate plans and has a broad array of experience with estate and trust administration. This area of her practice includes:

  • Drafting of power of attorney documents
  • Drafting health care power of attorney documents and living wills
  • Trust creation
  • Trust administration
  • Special needs trust establishment

Her work often takes her to Orphans’ Court, where she assists clients regarding the intricacies of special needs trust administration and guardianships of the person and of the estate. Those are legal tools that allow a person or entity to make decisions for another person of any age who is incapacitated or has certain special needs.

In her business practice, Sarah deals almost exclusively with the needs of nonprofit corporations, including religious entities and youth sports organizations. Her work advising nonprofit corporations includes:

Lauralee B. Baker

Lauralee is a partner in the firm’s Litigation Practice Group and Health Care Industry Group. She represents health care providers such as hospitals and physicians in medical malpractice defense litigation and before regulatory agencies. In her more than 35 years of practice, she has tried more than 60 jury cases to verdict with the vast majority concluded in favor of her client.

Lauralee brings a unique perspective to her health care and litigation trial practice as she has a medical background with both a RN and BS in nursing. She counsels her health care clients in compliance, assisting them with the minimization of risk and exposure to liability. Lauralee is well-versed in regulations and current issues facing the health care industry and has spoken on issues such as informed consent, health care risk management and electronic medical records.

With Lauralee’s extensive experience in jury trials in both state and federal court, she has represented physicians, nurses and hospitals in dozens of counties across Pennsylvania. In addition, she has represented physicians and nurses in regulatory matters before the applicable state regulatory agency.

W. Jeffrey Sidebottom

Jeff Sidebottom is the former chair the Workers’ Compensation Law Group and focuses his practice on advising clients regarding workers’ compensation issues and representing clients in related litigation. When providing counsel on workers’ compensation matters, he works closely with other members of the firm’s Employment Law Group to provide coordinated full-service risk management advice for the benefit of the firm’s clients.

Jeff has handled workers’ compensation cases throughout Pennsylvania for clients, including self-insured employers, insurance carriers and third-party administrators, as well as businesses such as hospitals, food processing companies, manufacturers and printing companies. Jeff has aggressively defended cases for businesses he represents to its final conclusion. When defending employers or businesses in workers’ compensation matters, Jeff believes it is absolutely essential to take a team approach in working and communicating on a regular basis with the insurer, third party administrator and representatives of the employer.

On many occasions, a workers’ compensation claimant has other employment-related issues with the client so Jeff takes a team-oriented approach with other members of the Employment Law Group to provide a coordinated approach while dealing with problem employees which can include FLMA, ADA, or termination issues. This coordinated advice approach is very helpful to clients when dealing with difficult or problem employees.

During his 45 years representing employers in the workers’ compensation field, Jeff has become very aware of the interests of businesses to reduce workers’ compensation costs, including litigation expenses. He has become an advocate for the interests of businesses dealing with the workers’ compensation system, both at the state and local levels. To this end, Jeff serves as a member of the Pennsylvania Chamber of Commerce’s Workers’ Compensation Executive Committee, which provides advice to the Chamber on possible legislative initiatives affecting the workers’ compensation system. Jeff has also been involved with the Lancaster Chamber of Commerce Workers’ Compensation Work Group which meets on a regular basis to address common issues of employers in Lancaster County dealing with workers’ compensation matters.

In addition, Jeff has served on the editing committee for the Pennsylvania Chamber’s Pennsylvania Workers’ Compensation Guide, a useful and informative book for businesses on how to deal with the workers’ compensation system in the state. Jeff authored an article that has been very useful for employers by providing a guide for understanding and dealing with the workers’ compensation litigation process and providing tips on how to increase the likelihood of a successful litigation outcome.

Larry C. Heim

Larry brings decades of experience in helping businesses in the hospitality industry with one of their most valuable assets – their liquor license. He has represented clients on issues before the Pennsylvania Liquor Control Board with appeals to the Court of Common Pleas and Commonwealth Court, defended liquor liability (“dram shop”) cases in state courts, and defended violations brought by the Pennsylvania Bureau of Liquor Code Enforcement, a division of the Pennsylvania State Police. He was the first attorney in Pennsylvania to obtain a limited winery license for a winery located in Europe with a satellite location in Pennsylvania coupled with a Restaurant License. He has also completed projects in South America to obtain PA manufacturing liquor licenses with satellite locations in Pennsylvania.

Larry is also a seasoned litigator in both state and federal courts with more than four decades of courtroom experience. While his practice deals mainly with cases in York County and in the U.S. District Court for the Middle District of Pennsylvania, he also has experience in courts outside of Pennsylvania, having been admitted pro hac vice in the federal courts of Maryland, New Jersey and Florida as well as the state courts of Montana, Texas and West Virginia. In addition, he has represented clients before many Pennsylvania administrative agencies such as:

  • Liquor Control Board
  • Real Estate Commission
  • Board of Finance & Review
  • Human Relations Commission
  • Consumer Protection Bureau
  • Environmental Hearing Board

On the federal level, Larry has had cases before the Equal Employment Opportunity Commission and the Occupational Safety and Health Review Commission (OSHA). With OSHA, he successfully defended a charge that resulted in a decision of industry-wide significance to the benefit of security agencies.

In his career, Larry has been a name partner at two different York County law firms. He has volunteered and held leadership positions at different organizations throughout that time, including national and local organizations that fight diabetes, help people overcome disabilities, and aid the overall community. He has also served in leadership positions for a number of professional and fraternal organizations in York County, throughout central Pennsylvania and across the state.
